1. ACCEPTANCE OF TERMS

By accessing or purchasing from porchbloomco.com (http://porchbloomco.com/), you agree to these Terms of Service and all applicable laws. If you do not agree, do not use our Website or purchase our products.

2. PRODUCTS

Porch Bloom Co sells outdoor goods and digital guide products. All physical items are new and unused.

3. BILLING & PAYMENT

All purchases are charged one time at checkout. Your bank statement will show the descriptor PORCHBLOOMCO. By completing a purchase, you authorize PC Abundance LLC to process your payment for the exact amount shown at checkout. We accept major credit and debit cards.

4. ORDER PROCESSING & SHIPPING

Orders are processed within 1–2 business days.

Average delivery time is 5–12 business days within the United States.

Shipping times may vary due to carrier delays, holidays, or supply issues.

You will receive a confirmation email and tracking information once your order ships.

5. RETURNS & REFUNDS

Due to hygiene and safety standards, we cannot accept returns of opened or used items.

We allow returns within 30 days only if the product is:

Unused,

Unopened,

In original packaging,

In resellable condition.

Customers are responsible for return shipping costs.

Approved refunds are issued to the original payment method within 3–7 business days after inspection.

6. CANCELLATIONS

Orders can be cancelled within 12 hours of purchase. Once an order is processed or shipped, it cannot be cancelled.

7. LIMITATION OF LIABILITY

PC Abundance LLC is not liable for:

Misuse of products,

Injuries caused by improper use,

Carrier delays,

Loss or theft after delivery confirmation,

Incidental or consequential damages.

Our total liability will not exceed the purchase price of the product.

8. WARRANTIES

Products are sold "as is" without any express or implied warranties, except as required by law. We do not guarantee any specific fitness or performance results.

9. INTELLECTUAL PROPERTY

All content on porchbloomco.com, including images, text, graphics, and trademarks, is the property of PC Abundance LLC and may not be used without permission.

10. GOVERNING LAW

These Terms are governed by the laws of the State of North Carolina.

11. BINDING ARBITRATION AGREEMENT & CLASS ACTION WAIVER

Arbitration Requirement

IF EITHER YOU OR PC ABUNDANCE LLC WANT TO BRING A CLAIM OR CAUSE OF ACTION AGAINST THE OTHER UNDER THIS AGREEMENT, OR IF ANY DISPUTE ARISES BETWEEN THE PARTIES AS A RESULT OF THIS AGREEMENT OR YOUR USE OF THE WEBSITE OR OUR PRODUCTS, EACH PARTY AGREES TO USE ARBITRATION AS THE SOLE AND EXCLUSIVE MEANS TO BRING SUCH A CLAIM OR CAUSE OF ACTION OR TO RESOLVE SUCH A DISPUTE.

YOU UNDERSTAND THAT BY AGREEING TO THE FOREGOING AND THE MORE SPECIFIC ARBITRATION TERMS BELOW, EACH OF YOU AND PC ABUNDANCE LLC ARE GIVING UP YOUR RIGHT TO FORM OR BE A PART OF A CLASS ACTION OR OTHER REPRESENTATIVE LAWSUIT. YOU ARE NOT WAIVING YOUR ABILITY TO SEEK OR RECOVER DAMAGES INDIVIDUALLY.

ALTHOUGH ARBITRATION PROCEDURES DIFFER FROM COURT PROCEDURES, AN ARBITRATOR CAN AWARD YOU INDIVIDUALLY THE SAME DAMAGES AND RELIEF AS A COURT, AND JUDGMENT ON THAT AWARD MAY BE ENTERED AND ENFORCED IN ANY COURT OF COMPETENT JURISDICTION.

Class Action Waiver

YOU AND PC ABUNDANCE LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. UNLESS BOTH YOU AND PC ABUNDANCE LLC AGREE OTHERWISE, THE ARBITRATOR MAY NOT CONSOLIDATE CLAIMS OR PRESIDE OVER ANY FORM OF REPRESENTATIVE OR CLASS PROCEEDING.

IF ANY PART OF THIS CLASS ACTION WAIVER IS DEEMED UNENFORCEABLE FOR A PARTICULAR DISPUTE, THEN THE AGREEMENT TO ARBITRATE DOES NOT APPLY TO THAT SPECIFIC DISPUTE, AND THE CLAIM MUST BE LITIGATED IN A COURT OF COMPETENT JURISDICTION. THE REMAINDER OF THE ARBITRATION AGREEMENT REMAINS ENFORCEABLE.

Arbitration Procedure

Arbitration will be conducted through the American Arbitration Association (AAA). The arbitration will take place in Cary, North Carolina, or via virtual/telephonic hearing if agreed. Each party is responsible for its own legal fees unless the arbitrator determines otherwise. The arbitrator's decision is final and binding.

12. INDEMNIFICATION

You agree to indemnify and hold harmless PC Abundance LLC, its employees, agents, contractors, and representatives from all claims, damages, losses, liabilities, and expenses arising from your use of our products or violation of these Terms.

13. CHANGES TO TERMS

We may update these Terms at any time. Continued use of the Website constitutes acceptance of any updated Terms.
